Liability Waiver

Introduction

In consideration of being permitted to participate in horseback riding, equestrian activities, and related services ("Activities") at JSR Equestrian Club ("the Facility"), I, the participant (or parent/guardian of the minor participant), acknowledge and agree to the following:

1. Acknowledgment of Inherent Risks

I understand and acknowledge that horseback riding and equestrian activities are INHERENTLY DANGEROUS and involve risks of serious injury or death. These risks exist regardless of the care, precautions, and expertise of the Facility, its staff, and instructors.

1.1 Risks Include But Are Not Limited To:

• Unpredictable Horse Behavior: Horses are large, powerful, unpredictable animals that may react suddenly to environmental stimuli, other animals, riders, or unforeseen events
• Falls: Riders may fall from horses due to horse movements, loss of balance, equipment failure, or other causes
• Physical Contact: Being kicked, bitten, stepped on, or struck by horses
• Terrain Hazards: Uneven ground, obstacles, sand, rocks, water, and environmental conditions
• Weather Conditions: Extreme heat, wind, rain, or other weather-related risks
• Equipment Failure: Saddles, stirrups, bridles, or other tack may break or malfunction
• Interaction with Other Riders: Collision with other horses, riders, or equipment
• Wildlife Encounters: Unexpected encounters with wildlife in desert or beach environments
• Transportation: Risks associated with horse transport or travel to riding locations
• Medical Emergencies: Lack of immediate medical facilities in remote riding locations

1.2 Potential Injuries

I understand that injuries may include but are not limited to:

• Broken bones, fractures, and dislocations
• Head injuries, concussions, and traumatic brain injury
• Spinal cord injuries and paralysis
• Cuts, bruises, abrasions, and lacerations
• Sprains, strains, and soft tissue injuries
• Permanent disability or disfigurement
• Death

2. Voluntary Assumption of Risk

I VOLUNTARILY ASSUME ALL RISKS associated with participation in Activities at JSR Equestrian Club, whether those risks are known or unknown, foreseen or unforeseen. I understand that these risks cannot be eliminated without destroying the essential nature of horseback riding.

I confirm that:

• I am participating entirely at my own risk
• I have been given the opportunity to ask questions about the Activities
• I have disclosed all relevant medical conditions, injuries, and disabilities
• I am physically and mentally capable of participating safely
• I will not participate if I am under the influence of alcohol or drugs

3. Release and Waiver of Liability

To the fullest extent permitted by the laws of the United Arab Emirates, I hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE JSR Equestrian Club, its owners, managers, employees, instructors, agents, contractors, volunteers, and affiliates (collectively "Released Parties") from any and all liability for:

• Personal injury, death, or property damage
• Any claims, demands, actions, or causes of action
• Any loss or damage arising from my participation in Activities
• Negligence of the Released Parties (except gross negligence or willful misconduct)

This release applies whether the injury or damage was caused by negligence, breach of contract, or any other cause, EXCEPT in cases of proven gross negligence or intentional misconduct.

4. Indemnification and Hold Harmless

I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising from my participation in Activities, including but not limited to:

• Claims brought by me or on my behalf
• Claims brought by family members or heirs
• Claims arising from my own negligence or misconduct
• Claims from third parties injured due to my actions

5. Medical Treatment Authorization

I authorize JSR Equestrian Club staff to obtain emergency medical treatment for me (or my minor child) if necessary. I understand that:

• I am responsible for all medical costs and expenses
• The Facility does not provide medical insurance for participants
• I should carry personal accident and medical insurance
• Emergency medical facilities may not be immediately available

6. Health and Fitness Declaration

I declare that:

• I am in good physical and mental health to participate in Activities
• I have disclosed all medical conditions, injuries, disabilities, or medications that may affect my ability to ride safely
• I do not have any condition (such as pregnancy, heart condition, back problems, etc.) that would make participation inadvisable
• My weight does not exceed the 87 kg maximum rider weight limit
• I will immediately inform staff if my health status changes

7. Agreement to Follow Rules and Instructions

I agree to:

• Follow all safety rules and instructions provided by JSR Equestrian Club staff
• Obey all posted warnings and facility rules
• Wear appropriate safety equipment, including mandatory riding helmets
• Wear appropriate clothing and closed-toe footwear
• Not participate if under the influence of alcohol or drugs
• Behave responsibly and respectfully toward horses, staff, and other participants

I understand that failure to follow instructions may result in immediate termination of my session without refund and may increase the risk of injury.

8. Photographic Release

I grant JSR Equestrian Club permission to use photographs or video footage of me (or my minor child) taken during Activities for promotional, marketing, or educational purposes without compensation. If I do not wish to be photographed, I will inform staff before the session.

9. Minors (Under 18)

If I am signing on behalf of a minor participant:

• I certify that I am the parent or legal guardian with authority to sign this waiver
• I accept all terms on behalf of the minor
• I agree to supervise the minor during Activities or authorize JSR Equestrian Club staff to supervise
• I understand the minor must be accompanied by a parent or authorized adult
• I agree to indemnify and hold harmless the Released Parties for any claims arising from the minor's participation

10. Severability and Governing Law

If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. This waiver shall be governed by the laws of the United Arab Emirates and subject to the exclusive jurisdiction of Dubai courts.

11. Acknowledgment of Understanding

I ACKNOWLEDGE THAT:

• I have read this entire waiver and fully understand its contents
• I understand this is a legal document that affects my rights
• I am waiving important legal rights, including the right to sue
• I am signing this document voluntarily, without any inducement or assurance
• I have had the opportunity to seek legal advice before signing
• This waiver is binding on me, my heirs, executors, administrators, and assigns
• This waiver shall remain in effect for all future visits and participation unless revoked in writing
